General Terms and Conditions for Customers

These General Terms and Conditions for Customers (including all other terms, policies, notices, guidelines, and forms referenced herein or otherwise available on the Platform or by hyperlink) (“Terms”) govern your use of the Platform and Service provided by ManyChef.

Please read these Terms carefully. By accessing and using the Platform, you agree that you have read, understood and accepted the Terms and consent to the processing of your personal data in accordance with the terms set out in the Privacy Policy (https://manychef.com/sg/privacy-policy/). If you do not agree with the Terms, please do not access or use the Platform and Service.

Definitions

Offer: the range of products and services offered by the Kitchen that can be ordered by you through the Platform.

Order: an order placed by you with the Kitchen through the Platform as regards the Offer selected by you.

Agreement: an agreement between you and the Kitchen regarding an Order and the fulfillment of the Order.

Platform: the website(s), apps, tools and other equipment of ManyChef and its affiliated companies and business partners on which the Service is made available.

Kitchen: a home-based food business that prepares and sells meals, beverages and related articles and uses the Platform for the establishment and payment of the Agreements.

Kitchen information: the information about the Kitchen with regard to, among other things, owner or company name, brand names and logos, graphics, address, product range (meals, side dishes, options and beverages), prices for each individual product, preparation times and pickup instructions.

Service: the commercial services and/or activities that are offered to you by ManyChef, including publication of the Offer, facilitation of the conclusion of Agreements and transmission of Orders to the relevant Kitchen.

1. Applicability

  1. These Terms are only applicable to the Platform and Service. ManyChef is not responsible for the Offer.
  2. By placing an Order you directly conclude an Agreement with the Kitchen for fulfilment of the Offer selected by you. You are bound by the Order and will not be entitled to a refund except in the case of cancellation allowed by or by the Kitchen pursuant to articles 4.2 and 4.3 below and Order discrepancies pursuant to article 4.8 below.

2. Use Of The Platform & Service

  1.  You will need to register for a ManyChef account for you to use the Platform. When you register for a ManyChef account we will ask you to provide your personal information including a valid email address, a WhatsApp mobile phone number and a unique password.
  2. To place an Order, depending on which payment method you opt for, you may need to provide us with your credit card details. ManyChef do not store your card details. All card details are securely stored by our payment processing service, Stripe.
  3. Your unique password should not be shared with anyone and you agree to keep it secret at all times. You are solely responsible for keeping your password safe. Save for cases of fraud or abuse which are not your fault, you accept that all Orders placed under your ManyChef account are your sole responsibility.

3. The Offer

  1. ManyChef publishes the Offer on behalf of the Kitchens on the Platform, in accordance with the Kitchen information supplied by the Kitchens. ManyChef shall not accept any responsibility or liability for the contents of the Offer and the Kitchen information on the Platform.
  2. The Kitchen may use ingredients and additives in meals and drinks that could cause allergies and intolerances. If you are allergic to any foodstuffs and could not rule out the presence of such allergens from the contents of the Offer as supplied by the Kitchen, we advise against placing an Order.
  3. ManyChef presents all Kitchen information in such a way that it is clear to you what your rights and obligations are after having accepted the Offer.
  4. ManyChef shall not accept any liability for Platform availability.

4. The Agreement

  1. The Agreement is effective as from the moment you finalise the Order by clicking the ‘Place Order’ button during the process of placing an Order through the Platform.
  2. After an Order is placed, the Kitchen will be able to either accept or reject (cancel) the Order. ManyChef will electronically confirm the Kitchen’s acceptance of the Order to you at the WhatsApp number you indicated when placing the Order, as well as via email.
  3. You will be able to cancel the Order through the Platform after 15 minutes have elapsed from the time the order was placed, as long as the Kitchen’s acceptance of the Order has not been confirmed, and
  4. At the cancellation of an Order, whether the cancellation was effected by the Kitchen, by you or by ManyChef, the authorisation hold on your card shall be immediately released by ManyChef and depending on your card issuer, may take a few days to be reflected in your statements.
  5. After having placed the Order, you are required to be available to receive status updates of your Order at the WhatsApp number as indicated when placing the Order.
  6. For “Self-collect” orders : A collection notification will be sent via WhatsApp once the Order is ready for collection and you agree to collect the Order within sixty (60) minutes from the “Ready” notification, or anytime before the end of the order’s scheduled collection time-slot, whichever is later, beyond which, the Kitchen shall not be obliged to hold on to or provide the Order to you with no refunds to be offered. You are responsible for verifying the correctness of the Order upon collecting it and to immediately report any discrepancy to the Kitchen. In the event that the Kitchen is not able to rectify a discrepancy, the Kitchen shall electronically issue a reimbursement of a mutually agreed-upon amount for the affected item(s) on the Platform. ManyChef shall process the reimbursement within 24 hours to your original payment method. You understand that discrepancies raised after the Order has been collected and has left the Kitchen’s premises will not be accepted for reimbursement or refund purposes.
  7. For “Delivery” orders : A delivery notification will be sent via WhatsApp once the Order is out for delivery to your address. You are responsible for verifying the correctness of the Order upon receiving it and to report any discrepancy by submitting a support ticket from your ManyChef account with clear details and photographs (if applicable) of the issue(s).
  8. ManyChef does not accept any liability relating to the execution of the Agreement. The sole responsibility for the Offer of the Kitchen and the performance of the Agreement lies with the Kitchen.

5. Payment

  1. At the moment the Agreement is concluded in accordance with the provisions of article 4.1, you are obliged to pay the Kitchen for the Order. You may fulfil this payment obligation by using an online payment method through the Platform.
  2. Subject to the provisions of articles 4.6 and 4.7, depending on your card issuer or bank, a reimbursement for an online payment may take up to 10 working days to be reflected in your card or bank account.
  3. ManyChef is authorised by the Kitchen to accept online payments on its behalf.

6. Data Protection

  1. ManyChef processes and protects your personal data in accordance with the Privacy Policy found here

7. Termination

  1. You are free at all times to use the Platform and Service (where and when available) and may terminate these Terms and your use of the Platform by closing your account.
  2. We may terminate these Terms and your access to the Platform and Service with immediate effect if we conclude that there is a breach by you of these Terms or any other agreement between you and ManyChef.
  3. ManyChef may, in its sole discretion, terminate these Terms or discontinue the Platform and Service at any time by giving you reasonable advance notice in writing.
  4. If we cannot charge the relevant charges to your preferred payment method we may suspend or remove your access to the Platform and Service until payment is made.
  5. You must immediately pay any outstanding charges upon termination. Any such charges will survive termination and we reserve all rights to collect payment after termination.

8. Your Liability and Indemnity

  1. You are liable for any damage suffered by us as a result of your violation of these Terms, your misuse of the Platform or your violation of any laws or third party rights. You are liable for all activities conducted through your account unless such activities are not authorised by you and you are not otherwise negligent.
  2. In order to have access to the Platform, you agree to indemnify, defend (at our option) and hold us and our respective officers, directors, and employees harmless from and against all claims, liabilities, expenses, damages, penalties, fines and taxes arising out of or related to a breach of these Terms, breach of applicable law or third party claims directly or indirectly related to your use of the Platform and Service.

9. Limitation of Liability

  1. Nothing in these Terms limits or excludes any liability which cannot legally be limited or excluded, including liability for death or personal injury caused by negligence and liability for fraud or fraudulent misrepresentation or alters your rights as a consumer that cannot be excluded under applicable law.
  2. ManyChef, its affiliates, directors, officers, employees, workers, agents and/or subcontractors are not liable under or in relation to these Terms including, but not limited to, liability in contract, tort (including negligence, misrepresentation), breach of statutory duty, restitution or otherwise for any of the following arising out of or in connection with the use of the Service made available through the Platform : (i) loss of profits; (ii) loss of sales or business; (iii) loss of agreements or contracts; (iv) loss of anticipated savings; (v) loss of use or corruption of software, data or information; (vi) loss of or damage to goodwill and (vii) indirect or consequential loss.
  3. ManyChef, its affiliates, directors, officers, employees, workers, agents and/or subcontractors are not liable for : (i) any Order whether it is accepted, completed, or otherwise cancelled by the Kitchen; (ii) damages or losses arising from any transaction between you and a third party provider; (iii) the availability and accuracy of the Offers published by the Kitchen; and (iv) delay or failure in performance resulting from causes beyond our reasonable control.
  4. Our total liability to you, arising out of these Terms or their subject matter, or in connection with the provision to you of the Platform and Service, in contract, tort (including negligence, misrepresentation), breach of statutory duty, restitution or otherwise, shall not exceed one hundred Singapore dollars (S$100).
  5. ManyChef, and its affiliate entities, are not liable for business losses. Platform and Service are provided only for private use. If you use Platform and Services for any commercial or business purpose ManyChef will have no liability to you for any loss of profit, loss of business, loss of revenue, business interruption, or loss of business opportunity (whether or not such loss could be reasonably expected to flow from our negligence or breach of these Terms).
